Please note, DPSP would not advise that this be the main method of dealing with your debts. The reason for this is due to the changes in the Unenforceable Credit Agreement Industry throughout 2009/10, resulting in claims taking a much longer period of time to be fully resolved. This whole process can take anything between 6 months to 2 years+ to complete a final outcome and even then if successful the agreement will simply be marked on your credit file as "Unenforceable".
Personal borrowing under the amount of £25,000 is covered by the Consumer Credit Act 1974 (CCA). The CCA was passed by Parliament to protect consumers as up until this point consumers were being misled by some lenders when borrowing money. To ensure consumers fully understood the conditions of their credit the CCA made it law for lenders to originate all credit by standardising the process through a number of prescribed proceedures.
The CCA also explains to lenders that if they don't follow the proceedures, as prescribed, then the debt will become unenforceable under the clause 127 of the CCA, until 2007, removes any judicial power that a judge has. Every form of credit originated under the CCA has either very simply:
- followed the prescribed terms and therefore the debt is enforceable OR
- broken the law by not following the prescribed terms therefore the debt is unenforceable
It is reported that millions of agreements over the last 30 years have not been originated within the law therefore it is essential that all running agreements are audited.
